| Annotation:
Article 4 of the Constitution gives Congress the sole power to admit new states to the Union. Territories and or properties of the United States can become states with Congressional approval, but there are no specific requirements for entry spelled out in the Constitution. No portion of a existing state or combination of states can become a state without both Congressional approval and the approval of the states affected by the change.

Article 4, Section 3, Clause 1
New States may be admitted by the Congress into this Union; but no new State shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or Parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress.
